1. Introduction
These Terms of Service ("Terms") govern your use of the Sprout Check website and our greenwashing assessment services ("Services"). By submitting an assessment request or using our website, you agree to be bound by these Terms. If you do not agree, you must not use our Services.
2. Our services
Sprout Check provides professional greenwashing assessments of business websites.
Our Services include:
- Reviewing environmental claims on the website URL you submit.
- Comparing those claims against publicly available ACCC guidance and Australian Consumer Law principles.
- Delivering a plain-language PDF report with flagged claims, suggested rewrites, and a priority action list.
We offer two assessment options:
- Full website audit: AUD $649 for websites of up to 25 pages.
- Home page assessment: AUD $249.
We aim to deliver reports within 3 business days for home page assessments and within 5 business days for full website audits after receiving payment. These timeframes are estimates only and are not guaranteed deadlines.
Our Services are provided with due care and skill, within a reasonable time, and in a way that is reasonably fit for the purpose you disclose to us, subject to Australian Consumer Law.
3. Not legal advice
IMPORTANT: Our assessments and reports are expert guidance only. They do not constitute legal advice, do not create a lawyer-client relationship, and are not a substitute for advice from a qualified lawyer.
While we work from publicly available ACCC guidance and Australian Consumer Law principles, we cannot guarantee that following our suggestions will prevent regulatory action or legal proceedings. Where we consider legal counsel appropriate, we will say so directly in your report.
The report is provided for your internal business use only.
4. Fees and payment
Our assessment fees are quoted in Australian dollars:
- Full website audit: AUD $649 for websites of up to 25 pages.
- Home page assessment: AUD $249.
Payment is required before we commence the assessment.
All fees are quoted in Australian dollars and include GST where applicable.
We do not offer refunds for change of mind. Where a refund or other remedy is required under Australian Consumer Law, we will provide it in accordance with the law.
If you are not satisfied with our Services, please email us at hello@sproutcheck.com.au and give us a reasonable opportunity to investigate and resolve the issue first. Depending on the circumstances, we may offer to correct, revise, or otherwise address the issue before any refund is considered.
If you cancel after work has started, we may retain an amount that is reasonable for work already completed and costs already incurred, to the extent permitted by law.
5. Your responsibilities
By using our Services, you warrant that:
- You are authorised to submit the website URL for assessment on behalf of the business.
- The information you provide, including the website URL and email address, is accurate and complete.
- You will not use our report or Services for any unlawful purpose.
- You understand that we may rely on the information you provide without independently verifying it unless we expressly agree otherwise.
6. Intellectual property
The PDF assessment report we deliver to you is provided for your internal business use only. You may:
- Use the report and its recommendations within your own business.
- Share the report with your legal advisers or internal teams.
You may not:
- Resell, redistribute, or publicly publish the report without our written consent.
- Remove our branding or represent the report as your own work.
- Use our methodology, templates, or frameworks for commercial purposes without a licence.
All content on our website, including text, design, branding, and graphics, is our intellectual property and may not be copied without permission.
7. Limitation of liability
To the maximum extent permitted by law:
- We are not liable for any indirect, consequential, special or punitive damages arising from your use of our Services or reliance on our report.
- Our total liability for any claim relating to our Services is limited to the amount you paid for the assessment.
- We are not liable for any regulatory action, fines, or legal proceedings arising from your use of our Services or materials, except to the extent such liability cannot be excluded under law.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot be excluded under Australian Consumer Law.
8. Confidentiality and privacy
We treat your website content and business information as confidential.
We will not disclose your information to third parties except as necessary to provide our Services, including payment processing, cloud storage, and other service providers, or as required by law.
Our collection, use and handling of personal information is described in our Privacy Policy, which should be read together with these Terms.
9. Termination
We may refuse service or terminate access to our website where reasonably necessary, including where we believe a user is acting in bad faith, providing misleading information, failing to pay, or seeking to use our Services for an unlawful purpose.
10. Governing law
These Terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved in the courts of New South Wales.
11. Changes to these terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Continued use of our Services after changes constitutes acceptance of the updated Terms.
